How to Cancel Employment Pass & Apply Special Pass in Malaysia

I would like to share some info regarding how to cancel Employment Pass (EP) and apply for special pass in Malaysia. All based on MY experience recently (October 2016).
So, as I told on previous blog, I was waiting my Long Term Social Visit Pass (LTSVP) to be done. And at that time, I'm holding EP. And my EP expired 14th October 2016, while my LTSVP will only be done at 19th October 2016. During the period 14 to 19 October, if I didn't apply for special visa, I will be illegally stay at Malaysia.
I finish work 30th September 2016 and my EP expired 14th October 2016. So my company decided they won't give special pass to me and said starting 1st October 2016, my company no longer paid me but I can still stay here till my EP expired 14th October 2016 (in a way, they give this as their "special visa") 😓😓😑😑
Here are the steps :
1) Ask your company to issue SPC form (tax clearence form)
* This suppose to be done by EMPLOYER. You can see the picture below. And the best part in my case is, my HR INSIST this is MY JOB to fill in the form, while its mention so obvious in the LHDN website that employer should fill in 1 month before my last day. And I just knew this things on 7th October 2016 (very stupid company).
* My HR said, without this tax clearance form, they unable to cancel my EP. So I tried to fill in all the form, calculating manually all my tax from 2015 & 2016 with my helped of my beloved husband, and found out my status is still on progress. I saw from LHDN website, usually this tax clearance form took 10 working days to be done (actually I just received the tax clearance letter yesterday. LHDN sent it to my home. In total they took 9 working days). When I told my HR about this, they said its OK (Damn! 💥💥💥💣💣) .
2) You need to ask your company to help cancel your EP
* Honestly speaking, in my case my HR have NO IDEA how to do it 😱😭. I've no idea how come my company can be so dare to hire foreigner staff and yet they didn't know these things?!! 😩😩💥💥💥 So at 1st they said they would help me to cancel my EP and after that I need to apply special visa myself at MDEC (because my EP was issued at MDEC). However, since I didn't trust my company, I tried to call MDEC few times and the staff said they won't entertain if we come individually without company help. HA! So I told my lousy HR about this, and they said they will help to provide all the document needed but I must come MYSELF 😔😠😠 (kinda expect this).
3) Bring all the document needed to MDEC (all document must be done by company)
* My HR provided all the document needed, few documents I saw are ; letter that stated I already resign from my work and they asked MDEC to help cancel my EP ; letter that asked MDEC help to issue me special visa for 2 weeks while waiting for my LTSVP to be done ; few documents that need your HR to fill in & sign on it.
* While I already at the MDEC immigration, the officer told me my HR forgot to fill in 1 more paper. WHATTTT! The paper is "special pass declaration". So I need to go back to my ex-company just to ask the HR to sign it & back to MDEC again. OMG!!!!!!!!!!!! I feel like killing my HR staffs, all of them, including the HR manager!!!!!!! 💣💣💣💥💥💥💥💥💢💢💢💢💢💢💢 Luckily the officer was very kind, he asked me to bring the document on Thursday (upon collection of my special pass).
So I submitted my cancellation of my EP on Tuesday 11th October 2016, and I can collect it by 13th October 2016. Not bad, just took 3 working days. I need to leave my passport with them. Oh yeah, the fee for the special visa is 100 RM (paid on the collection date).
4) Collecting passport & special visa
I collect my passport on 13th October 2016. When I came (around 10 AM), the officer checked my receipt, showed me that my EP has already stamped & cancelled and he asked me paid 100 RM for the special pass (paid at the cashier counter). After that he told me to wait within 30 minutes because they need to issue the special visa. But within 15 minutes, he called my name already.
When I check the immigration did stamp & cancelled my EP and the special visa was actually just a piece of paper, stapler inside my passport 😂😂😂. I was kinda surprise because I thought it'll be a sticker 😂😂😂. I paid 100 RM just to get a stamp & paper 😂😂😂.
Note : It was very frustrating journey if your company have no idea & not helpful enough. I almost break down because of my ex-company didn't know what to do 💢💢💢. I really salute my ex-company at Singapore because I can count on them when I resign, they know what to do and they can advise me what to do before I leaving Singapore (paid my tax, etc). But here at Malaysia... everything was so much different. I still don't understand how come since the beginning, a HR can gave so much wrong information when they hire foreigner staffs 💣💣💥💥💢💢💢💢💢💢💢. After I resign, I got information from my ex colleagues that my ex-company just got fined because they got caught by immigration people (who did random check). The reason ; because my ex-company hired cleaning service staffs WITHOUT VALID WORKING PASS!! OMG!!! I'm so glad I already resign and get out from there. What a very SUCKS company!!
I hope this information will be helpful to you. Since most of the people blog that I saw that applying LTSVP don't have same case like me. Most of them applying using tourist visa. And I do think its easier to apply using tourist visa (save the time & trouble).
